When a Citibank credit card fraud dispute is denied, many consumers assume there is nothing more they can do. Our client, Mr. N, didn’t give up. Neither did we.
Citibank alerted Mr. Netland to four charges pending on his credit card. He immediately identified the charges as fraudulent and called Citibank to dispute them. But Citibank denied his dispute, concluding that because the transactions involved a chip-enabled card, Mr. Netland must have made them. The amount at issue was $1,085.
For a large bank, $1,085 may not seem like much money. For a consumer being forced to pay fraudulent credit card charges, it matters.
So we took Citibank to arbitration under the Fair Credit Billing Act.
Citibank fought the case. It filed a general denial and 22 affirmative defenses. Both sides eventually filed motions for summary judgment, and the case proceeded toward an evidentiary hearing.
Shortly before the scheduled hearing, Citibank agreed to settle. Mr. Netland would receive his money back plus damages. He also received his attorney’s fees and costs. This case never cost him a dime out of pocket.
The arbitrator rejected Citibank’s request for an across-the-board 20% reduction. More importantly, after reviewing our billing records entry by entry, he found that I had done “by far the lion’s share of the work” and had “achieved a successful result” for my client. He further found that, with limited exceptions, my work was handled “efficiently, effectively and without duplication.”
The final award required Citibank to pay Mr. Netland his damages and return this money.
But Citibank still wasn’t finished.
A bank’s denial does not necessarily mean the dispute is over. In fact, that is when we start our fight against the bank. Consumers have important rights under federal law, and sometimes enforcing those rights means taking on one of the largest banks in the country.
